Legal Protection in Israel: How It Really Works
Neighbours, consumer issues, work: legal protection pays your lawyer's fees for everyday disputes in Israel, subject to conditions.
Legal protection is an insurance that pays all or part of the lawyer's and court fees when you are involved in an everyday dispute: a conflict with a neighbour, a disagreement with a shopkeeper, a dispute with an employer. In Israel, it most often works as a contract in its own right, separate from home insurance or car insurance, and it reimburses the lawyer's fees incurred to defend you.
What legal protection covers in Israel
Legal protection contracts aimed at individuals generally cover several areas of civil law: liability law, for damage caused or suffered, property, employment relations, road traffic, certain aspects of family law, as well as tax and contract law. The insurance steps in to fund a lawyer's fees when proceedings are started during the period of cover, and sometimes even for events that occurred up to a year before the policy was taken out, depending on the terms of the contract.
Concrete everyday situations
A conflict with a neighbour who encroaches on a shared area, a dispute with a shopkeeper after buying a faulty product, a disagreement with an employer over a breach of contract or unpaid hours: these are typically the kind of disputes where legal protection steps in. You could also think of a dispute with a building committee (vaad bayit) over contested charges, or a disagreement with a tradesman who did not finish the work properly. For a French speaker settled in Israel, often less familiar with the local legal system and the language of proceedings, this type of cover can make a real difference, by allowing you to be directed to a competent professional without having to fund the first steps alone, at a time when you do not always know where to start.
Legal protection and civil liability: two different covers
It is common to confuse legal protection with civil liability, although they play opposite roles. Civil liability applies when you are the one who caused damage to a third party, for example water damage at a neighbour's: it compensates the victim in your place. Legal protection, on the other hand, applies when you are the victim or the party who has to defend themselves in a dispute, whether it concerns damage you suffered or an action brought against you: it funds your lawyer's and procedural costs. The two covers are complementary, and many households in Israel hold them without always distinguishing between them.
What is not covered
Legal protection is not a universal insurance. Contracts aimed at individuals generally exclude serious criminal law, above a certain level of penalty faced, divorce proceedings and the issues that follow from them, as well as the insured person's professional or commercial activity. A useful phrase to remember: legal protection covers everyday disputes, not the heaviest lawsuits or the subjects excluded by the contract, which makes it a complement and not a substitute for civil liability insurance or professional insurance.
Taking out the policy is generally restricted to adults and requires that there be no proceedings or conviction in progress at the time of signing, over a recent period defined by the contract.
How it works in practice
In practice, as soon as a dispute arises, the insured person reports the claim to their company, which assesses whether the case is eligible under the contract. Depending on the policy, the insurer may refer the insured person to a lawyer in its network or reimburse the fees of a freely chosen lawyer, up to a ceiling set in the contract. Some contracts also include, as an option, psychological support in particularly distressing situations, for a few sessions for the insured person and their relatives.
Taking it out alone or as an addition to another contract
Legal protection can exist as a stand-alone contract, entirely dedicated to this cover, or as an option added to another insurance, for example car insurance or home insurance, where it then mainly covers disputes linked to the vehicle or the home. Some insurers offer wider cover that goes beyond these areas and extends to everyday disputes in general. The right formula depends on your situation, on what your other contracts already cover, and on the subjects for which you feel most exposed, whether it is your home, your vehicle or your professional activity.
Choosing your legal protection well as a newcomer
For an oleh or an expatriate, the main obstacle is not only financial, it is also the language barrier and a lack of familiarity with the Israeli legal system. Legal protection suited to your personal situation can defuse a conflict before it gets out of hand, provided it is well calibrated from the start. Since covers, exclusions and ceilings vary significantly from one contract to another, it is recommended to review things with a professional who knows both the Israeli market and the specific needs of a French speaker.
